How has the EU made big changes to the Data Protection Regulation over the last decades?

The changes to our data protection law started in the mid-1980s when the European Union adopted Directive 91/477 and its predecessor in 1993 and the Schengen Area was introduced in 1994. Between 1992 and 1998 the EU adopted new or amended laws for the protection of personal data. Between 1997 and 2003 the Data Protection Directive was amended several times, including the Privacy and Electronic Communications Directive of 2000 and the Electronic Communications Privacy Directive of 2008. The Directive 90/477 took effect in 1993 without making any major changes to the directive, while the new Data Protection Regulation, adopted in 2004, gave further legislative and regulatory power to the Commission to introduce new laws or amendments to existing laws.

The most recent data protection change is that of April 2016, when the European Parliament approved the new and further strengthening of the data protection regime in the European Union. The amended Data Protection Regulation allows for companies to use data to fulfil their activities in the EU without having to comply to national laws, which is called ‘European Standardisation’.

This means that the Commission can now change or update national provisions on data protection without the risk of being held to account by national authorities. It also means that data protection can be more easily accessed by citizens throughout the
